REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Australian Education Union, Tasmanian Branch and the Tasmanian Union of Professional and Clerical Officers in Education, was for the purpose of filing an industrial agreement with the Commission.

[2] On 13 January 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on 19 January 2004 at 10.30 am.

[3] The agreement, to be known as the AEU Tasmanian Branch Employees' Agreement 2003, and with the approval of the parties is to be operative from the first full pay period on or after 19 January 2004 and it is to remain in force for a period of three years.

[4] The agreement replaces and supersedes the AEU Tasmanian Branch Employees' Agreement 2002 [T10770 of 2003]. The key difference between the two agreements centres on the salaries and classification structure.

[5] Mr C Lane for the Australian Education Union, Tasmanian Branch presented submissions in support of the consent application, and Ms G Mitchell for the Tasmanian Union of Professional and Clerical Officers in Education endorsed his submissions.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
