REASONS FOR DECISION

[1] On 20 February 2004, an application was lodged by the National Union of Workers (Central Branch), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Butter and Cheesemakers Award.

[2] The application sought to insert a new Carer's Leave clause and a new Requirement to Work Reasonable Overtime clause.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 17 March 2004 at 9.30 am.

[4] At the hearing Mr P Richardson appeared for the National Union of Workers (Central Branch). Mr P Gourlay appeared on behalf of the Tasmanian Chamber of Commerce and Industry Limited.

[5] Mr Richardson and Mr Gourlay presented oral submissions in support of the application.

[6] The award will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[7] The order reflecting this decision, with an operative date of 17 March 2004, is attached.
