REASONS FOR DECISION

[1] This is an application by the National Union of Workers (Central Branch) (NUW), lodged pursuant to s.65A of the Industrial Relations Act 1984, seeking a determination of "Interest" in the above award. The President has referred the application, pursuant to Section 65A(2), to myself for hearing and determination and, if necessary, subsequent award variation. The application was set down for hearing on 17 March 2004.

[2] Mr P Richardson appeared for the NUW.

[3] In support of the application Mr Richardson relied on an affidavit sworn by Douglas Robert Stevens, Secretary of the National Union of Workers (Central Branch).

[4] Having considered the submissions, I am satisfied that:

  • The Union has members engaged in the industry or occupation to which the Award relates;
  • The membership is consistent with the organisation's rules;
  • The granting of the application would not prejudice the orderly conduct of industrial relations in Tasmania.

[5] I therefore find that the requirements of the Act have been satisfied.

[6] Pursuant to s.63(10)(c) the application is granted operative from 17 March 2004.

[7] A copy of this determination will be forwarded to the Registrar in accordance with s.63(12) of the Act.

[8] The Order giving effect to this decision is attached.
