REASONS FOR DECISION

[1] On 1 March 2004 the Australian Municipal, Administrative, Clerical and Services Union and the Royal Society for the Prevention of Cruelty to Animals (Tasmania) Inc. lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The RSPCA Industrial Agreement 2004.

[2] When this matter came on for hearing on 23 March 2004, Mr I Paterson appeared for the union. Mr P Mazengarb, of the Tasmanian Chamber of Commerce and Industry Limited, appeared for the employer.

[3] Mr Paterson explained that this agreement is to prevail over any other awards that might otherwise apply. In recognition of the specific circumstances of the employer and employees, the agreement provides for:

    · Wage adjustments in line with the CPI on an annual basis.

    · A schedule of adjustments to the base rate over the life of the agreement.

    · Public holiday work to be paid at the rate of double time and one half or any agreed mix of payment and time off in lieu.

    · A phased in penalty for Sunday work inclusive of the casual loading.

    · Salary sacrifice.

[4] Mr Mazengarb supported the submissions of Mr Paterson.

[5] Having some first hand knowledge of the process behind the agreement negotiations I congratulate the parties on bringing this matter to finality. The agreement meets the operational needs of the Society, provides appropriate protection for employees and removes past uncertainty as to award coverage.

[6] I am satisfied the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s. 55[4] of the Act the agreement is approved operative from 23 March 2004 and shall remain in force for a period of three years.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
