REASONS FOR DECISION

[1] On 12 March 2004, the Health Services Union of Australia, Tasmania No. 1 Branch and Grenoch Home Inc. lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Grenoch Home Inc. (Split Shifts) Industrial Agreement 2004.

[2] When this matter came on for hearing on 16 March 2004, Mr Paul Burford, together with Mr M Vizard appeared for the union. Mrs P Von Steiglitz appeared for the employer.

[3] Mr Burford explained that the purpose of the agreement was to facilitate split shifts in defined circumstances, the need for which arose from a staffing restructure which had become necessary as a consequence of financial difficulties facing the home.

[4] Mrs Von Steiglitz supported the submissions of Mr Burford.

[5] I am satisfied the Agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] Pursuant to s. 55[4] of the Act the agreement is approved operative from the beginning of the first pay period to commence on or after 16 March 2004 and shall remain in force for a period of 12 months.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
