LACTOS INDUSTRIAL AGREEMENT 2004

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branch (the union) and Lactos Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 30 April 2004 at 9.45 am.

[3] The agreement, to be known as the Lactos Industrial Agreement 2004, is to be operative on and from 1 January 2004 and it is to remain in force for a period of two years.

[4] The agreement covers Lactos' manufacturing, laboratory and warehouse operations at all sites in Tasmania.

[5] Mr R Flanagan of The Australian Workers' Union, Tasmania Branch wrote to the Commission prior to the hearing advising that the Tasmanian Chamber of Commerce and Industry Limited (TCCI) would be representing the union in the matter.

[6] An oral submission was presented by Mr M Watson of the TCCI.

[7] Having considered this submission, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.

[8] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
