Industrial dispute - alleged unfair termination of employment - no instructions from applicant - applicant failed to attend conciliation conference - application dismissed REASONS FOR DECISION [1] On 7 April 2004, Leigh Michell (the applicant) applied to the President, pursuant to Section 29(1A) of the Industrial Relations Act 1984, for a hearing before a Commissioner in respect of an industrial dispute with Bugg and Goninon Pty Ltd Insurance Brokers - Risk Consultants arising out of his alleged unfair termination of employment. [2] The matter was set down for conciliation conference on 26 May 2004 in Launceston. [3] Appearances: Ms D Butler, Launceston Community Legal Centre, for the applicant. Mr D Durkin, Durkin & Associates, for the respondent. [4] Ms Butler advised the Commission that she was without instructions and her client was not present at the conciliation conference. Mr Durkin sought to have the application dismissed. [5] Having regard to Ms Butler's submissions regarding her lack of instructions, and in the absence of the applicant, the application is dismissed. I so order.
