REASONS FOR DECISION

[1] On 14 April 2004, an application was lodged by the Australian Municipal, Administrative, Clerical and Services Union, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Public Vehicles Award.

[2] The application sought to vary Clause 1 - Wage Rates of Part III - WAGE CLASSIFICATIONS AND RELATED MATTERS in line with the Third Minimum Rates Adjustment.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Thursday 22 April 2004 at 10.30 am.

[4] At the hearing Mr I Paterson appeared for the Australian Municipal, Administrative, Clerical and Services Union. Mr M Watson appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[5] Both parties gave submissions in support of the application.

[6] The award will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[7] The Order giving effect to this Decision is attached.
