REASONS FOR DECISION

[1] On 19 April 2004, the Minister Administering the State Service Act 2000 and the Tasmanian Branch of the Australian Medical Association (AMA) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Rural Medical Practitioners (Public Sector) Agreement 2003.

[2] When this matter came on for hearing on 23 April 2004, Mr G Foale and Mr J Milbourne appeared for the Minister. Mr D Lowe appeared for the AMA.

[3] Mr Foale explained that this agreement provided for a total salary increase of 10% in two instalments of 5% each. Mr Foale gave an undertaking that the salary adjustment operative from 1 November 2003 would be processed administratively, notwithstanding the later operative date for the formal commencement of the agreement.

[4] A new clause Extended Service Availability Fee with a four-tier structure had been included and replaced the previous on-call and availability allowance.

[5] Anaesthetic and Surgical Allowances had also been included.

[6] Parental Leave and Salary Sacrifice and Packaging provisions were included as appendices to the agreement.

[7] Mr Lowe supported the submissions of Mr Foale.

[8] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[9] Pursuant to s.55[4] of the Act the agreement is approved operative from the beginning of the first pay period to commence on or after 23 April 2004 and shall remain in force for a period of three years.

[10] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
