REASONS FOR DECISION

[1] On 19 April 2004, the Minister Administering the State Service Act 2000 and the Tasmanian Salaried Medical Practitioners' Society (TSMPS) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Salaried Medical Practitioners Industrial Agreement 2003.

[2] When this matter came on for hearing on 23 April 2004, Mr G Foale and Mr J Milbourne appeared for the Minister. Mr D Lowe appeared for the TSMPS.

[3] This agreement provides for salary increases over the life of the agreement ranging from 9% for Salaried Medical Practitioners, 15.25% for Specialist Medical Practitioners and 21% for Specialist Medical Practitioners in Training Level II. Mr Lowe noted that these salary adjustments would significantly enhance the position of Tasmania in the context of the national medical market at the senior levels.

[4] Mr Foale gave an undertaking that the retrospective salary adjustment would be processed administratively given the subsequent formal commencement of the agreement.

[5] Clause 13 Excess Time had been modified to recognise the impact on OH&S considerations. The scale of penalties would be progressively increased over the life of the agreement and a working party had been established to review rostering practices.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.55[4] of the Act the agreement is approved operative from the beginning of the first pay period to commence on or after 23 April 2004 and shall remain in force until 1 July 2006.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
