REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984, by The Sunlea Team Inc. (the employer), and the Health Services Union of Australia, Tasmania No. 1 Branch (the HSUA), was for the purpose of filing an industrial agreement with the Commission.

[2] Mr C Stringer appeared for the HSUA and Ms J Watts for the employer.

[3] The agreement, to be known as The Sunlea Team Inc (Co-ordinators Salary) Industrial Agreement 2004, has as its operative date 5 April 2004 and shall remain in force for a period of two years.

[4] Mr Stringer informed the Commission that the purpose of the agreement was to "provide for a salary package for the position of Co-ordinator." The need for such an approach, it was said, arose from the fact that the relevant award, the Disability Service Providers Award, did not make provision for the classification of Co-ordinator.

[5] Mr Stringer also submitted that the agreement was consistent with the general public interest provisions of section 36 of the Act.

[6] Ms J Watts, for the employer, supported the submission of Mr Stringer.

[7] Having heard the submissions of the parties in this matter, I am satisfied that the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[8] The file will now be referred to the Registrar in accordance with the requirements of section 56(1) of the Act.
