REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union, the Community and Public Sector Union (State Public Services Federation Tasmania) Inc., the Australian Municipal, Administrative, Clerical and Services Union (the unions) and Hobart Regional Water Authority trading as Hobart Water (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 19 May 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Thursday 3 June 2004 at 9.30 am.

[3] The agreement, to be known as the Hobart Regional Water Authority (Hobart Water) Enterprise Agreement 2003, is to be operative on and from 1 July 2003 and it is to remain in force until 30 June 2006.

[4] The agreement applies to Hobart Regional Water Authority, trading as Hobart Water, and its employees, the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union, the Community and Public Sector Union (State Public Services Federation Tasmania) Inc., and the Australian Municipal, Administrative, Clerical and Services Union

[5] At the hearing I amended Clause 58.3.1 - Long Service Leave of the agreement. Oral submissions were presented by Mr P Baker of the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union and by Mr P Mazengarb of the Tasmanian Chamber of Commerce and Industry Limited.

[6] Having considered those submissions, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
