REASONS FOR DECISION

On 24 May 2004, an application was lodged by the The Community and Public Sector Union (State Public Services Federation Tasmania) Inc., pursuant to s.23 of the Industrial Relations Act 1984, to vary the General Conditions of Employment Award, the Community and Health Services (Public Sector) Award, the Sea Fisheries Award and the Police Departmental Employees Award.

The application sought to vary expense related allowances.

A hearing was convened at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 9 June 2004 at 9.30 am.

At the hearing Mr R Miller appeared on behalf of the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. Mr T Jacobson appeared for the Health Services Union of Australia, Tasmania No. 1 Branch and Mr J Evans appeared for the Minister administering the State Service Act 2000.

Oral submissions in support of the application, which was by consent, were presented by Mr Miller, Mr Jacobson and Mr Evans.

The award will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

The Orders giving effect to this Decision are attached.
