COMMISSIONER JP McALPINE

HOBART, 21 June 2004

Industrial Agreement - agreement approved - operative from the ffpp on or after 21 June 2004 - for a period of 12 months - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the HSUA) and Langford Support Services Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 9 June 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on 21 June 2004.

[3] The agreement, to be known as the Langford Support Services Inc. (Managers' Employment Conditions) Industrial Agreement 2004, is to be operative from the first full pay period to commence on or after 21 June 2004 and remain in force for a period of 12 months.

[4] The agreement applies to employees employed by the employer as "Business Unit Managers".

[5] Mr T Kleyn for the union and the employer, presented submissions in support of the consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
