REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the National Union of Workers (Central Branch) and Statewide Independent Wholesalers Limited, was for the purpose of filing an industrial agreement with the Commission.

[2] On 22 June 2004, the Commission convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Monday, 5 July 2004 at 9.30 am.

[3] The agreement, to be known as the Statewide Independent Wholesalers Frozen and Chilled Distribution Centre - NUW Enterprise Agreement 2004 - 2005, is to be operative from 1 January 2004 and it is to remain in force until 30 June 2005.

[4] The agreement applies to all employees for whom classifications appear in the agreement of Statewide Independent Wholesalers Limited at its Frozen and Chilled Distribution Centre at 13 Richard Street, Breadlebane in Tasmania.

[5] Mr B Bolitho for the National Union of Workers (Central Branch); and Ms J Thomas, from the Tasmanian Chamber of Commerce and Industry Limited, for Statewide Independent Wholesalers Limited, presented submissions in support of the consent application.

[6] Having considered the submission of the parties, I am satisfied the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Acting Registrar in accordance with the requirements of s.56(1) of the Act.
