Industrial dispute - alleged breach of agreement - Order issued - file closed

REASONS FOR DECISION

[1] On 9 July 2004, the Musicians' Union of Australia, Hobart Branch (the applicant), applied to the President, pursuant to s.29(1) of the Industrial Relations Act 1984, for a hearing before a Commissioner in respect of an industrial dispute with Mr Harvey Coghlan, HC Theatre Productions (the respondent), arising out of an alleged breach of agreement - Mr J Beresford.

[2] The President convened a hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania on 2 and 10 August 2004.

[3] After hearing preliminary submissions from the applicant, the respondent confirmed that he had paid the first instalment of $80.00, but had failed to continue the instalments in reduction of an amount due and owing to the applicant's member, Mr J Beresford.

ORDER:

Pursuant to s.31 of the Industrial Relations Act 1984, I hereby Order Mr Harvey Coghlan, HC Theatre Productions (the employer) pay to the Musicians' Union of Australia, Hobart Branch, 113 Main Road, Moonah, Tasmania 7009 (PO Box 579, Moonah, Tasmania 7009) the sum of Four hundred and seventy dollars ($470.00), and such payment to be made in six fortnightly instalments as follows:

2.   This Order is in full and final settlement of the dispute, stated in application T11587 of 2004.

3.   Nothing in this Order shall be construed as to prevent the employer from paying the above-mentioned instalments in full prior to the due dates.

4.   Further, if the employer defaults on any of the payments set out in this Order, then the balance of the money outstanding is due and payable within seven (7) days of the date of default.
