Industrial agreement - application approved - operative date ffpp 16 July 2004 - 31 December 2006 - forwarded to Registrar for registration REASONS FOR DECISION [1] On 12 July 2004, the Minister Administering the State Service Act 2000 and the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tasmanian Ambulance Service Enterprise Bargaining Agreement 2004. [2] When this matter came on for hearing on 16 July 2004, Mr J Milbourne and Miss K Fearnley-Sander appeared for the Minister. Mr T Kleyn appeared for the HSUA. [3] Mr Milbourne explained that the agreement was to apply to all employees of the Ambulance Service. [4] The Agreement provided for wage adjustments in accordance with the following schedule:
[5] A joint working party is to be established with the objective of consolidating the relevant clauses from this and other agreements currently on foot, into the award. [6] Other matters in the agreement include:
[7] A number of other matters had been adopted from the Public Sector Unions Wages Agreement No 2 of 2004.1 [8] Mr Kleyn supported the submissions of Mr Milbourne and advised that a membership ballot had overwhelmingly endorsed the agreement. [9] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [10] Pursuant to s.55(4) of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 16 July 2004 and shall remain in force until 31 December 2006. [11] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
