INGHAMS ENTERPRISES (FARMING) INDUSTRIAL AGREEMENT 2004

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branch (the union) and Inghams Enterprises Pty Ltd (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] The agreement, to be known as the Inghams Enterprises (Farming) Industrial Agreement 2004, is to be operative from the first full pay period to commence on or after 12 August 2004 and it is to remain in force until 31 May 2005. It will apply exclusively to employees of the employer engaged in the poultry farming, hatchery and feedmill operations. However, it will not apply to salaried or clerical employees.

[3] This agreement is similar to previous agreements approved by the Commission and, in summary, provides for two wage increases:

  • The first increase was operative from the first full pay period to commence on or after 2 June 2003; and
  • the second is operative from the first full pay period to commence on or after 2 June 2004.

[4] Mr J Jones for the employer, and Mr I Wakefield for the union, presented submissions in support of their application.

[5] Having heard the submissions of the parties in this matter, I am satisfied that the agreement should be approved as it is consistent with the public interest requirements of the Act, and I decide accordingly.

[6] The agreement will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
