REASONS FOR DECISION

[1] On 21 July 2004, the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union and Emu Bay Engineering Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Emu Bay Engineering Pty Ltd Enterprise Agreement 2004.

[2] When this matter came on for hearing on 9 September 2004, Ms D Sargent appeared for the Union. Mr C Peach appeared for the Company.

[3] Ms Sargent advised that the agreement provided for wage increases of 3.25% per annum to apply from 1 July each year.

[4] Mr Peach indicated that the Company consented to the agreement.

[5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] Pursuant to s.55(4) of the Act, the agreement is approved operative from 1 January 2004 and shall remain in force for a period of thirty six months.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
