REASONS FOR DECISION

[1] On 28 July 2004, applications were lodged by The Australian Workers' Union, Tasmania Branch, (AWU) pursuant to s.23 of the Industrial Relations Act 1984, to vary the Farming and Fruit Growing Award, the Fish, Aquaculture and Marine Products Award, the Plant Nurseries Award, and the Shellfish Industries Award

[2] The application sought to vary the Superannuation clause of each award.

[3] At the hearing on Monday 6 September 2004, at the Commonwealth Law Courts, 39-41 Davey Street, Hobart Mr R Flanagan appeared for the AWU while Mr M Watson appeared for the Tasmanian Chamber of Commerce and Industry Limited (TCCI) and Mr K Rice on behalf of the Tasmanian Farmers and Graziers Employers Association (TFGEA).

[4] Mr Flanagan and Mr Watson both gave submissions in support of the applications, which were by consent, as did Mr Rice in respect of the Farming and Fruit Growing Award

[5] The award will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The orders reflecting this decision, with an operative date of 6 September 2004 are attached.
