REASONS FOR DECISION

[1] On 29 July 2004, the Health Services Union of Australia, Tasmania No. 1 Branch and The Hobart Clinic lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The Hobart Clinic Hospital Staff Enterprise Bargaining Agreement 2004.

[2] When this matter came on for hearing on 3 August 2004, Mr C Stringer, with Ms C Kennedy appeared for the union. Mr M Watson, of the Tasmanian Chamber of Commerce and Industry Limited, appeared for the employer.

[3] Mr Watson explained that this was the fourth agreement to be negotiated by the parties and was a reflection of the extremely stable and constructive industrial environment at the workplace.

[4] Changes incorporated into this agreement included:

  • Paid maternity leave.
  • Daylight saving arrangements.
  • Union training.
  • Carer and sick leave.

[5] The agreement provided for three salary adjustments of 4.2% each, operative from 1 July each year.

[6] Mr Stringer supported the submissions of Mr Watson.

[7] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[8] Pursuant to s.55[4] of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 1 July 2004 and shall remain in force until 30 June 2007.

[9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
