Award variation - amend and update trainee provisions - wage rates - training packages - consent matter - application granted - award varied - operative ffpp 1 August 2004 REASONS FOR DECISION [1] On 29 July 2004 an application was lodged with the Commission, pursuant to s.23 of the Industrial Relations Act 1984, by the Tasmanian Trades and Labor Council (the applicant). [2] The applicant sought to vary and update the National Training Wage (Tasmanian Private Sector) Award, and in particular to the trainee provisions, wage rates and training packages. [3] When the matter came on for hearing the applicant was represented by Ms L Fitzgerald and Mr Paul Griffin. [4] Ms Fitzgerald presented Exhibit A.1 and outlined the changes to the award. [5] In response, Ms J Thomas for the Tasmanian Chamber of Commerce and Industry (TCCI) Limited, submitted that the TCCI consented to the variations sought with an operative date of the first full pay period to commence on or after 1 August 2004. [6] Having heard the submissions from the parties, I am satisfied that the National Training Wage (Tasmanian Private Sector) Award should be varied in the manner sought by the applicant and, in approving the application, I am satisfied it is not contrary to the public interest test required pursuant to s.36 of the Act. [7] The Order giving effect to this decision is attached.
