REASONS FOR DECISION

[1] On 30 July 2004, an application was lodged by Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Plumbers Award.

[2] When this matter came on for hearing on 4 August 2004, Mr P Fraser appeared for the CEPU, Mr P Gourlay appeared for the Tasmanian Chamber of Commerce and Industry Limited and Mr A Cowie appeared for The Master Plumbers' Association of Tasmania.

[3] Mr Fraser explained that this application seeks to delete all existing clauses in the award and replace with a document that was agreed between the parties following extensive consultations over recent months.

[4] The proposed new award brings it broadly into line with the federal Plumbing Trades (Southern States) Construction Award 1999.

[5] The new award also incorporates all previous Safety Net Adjustments which have hitherto not been applied to wage rates in the award.

[6] Given that the new award will result in substantial change to wage rates and conditions the parties had agreed to a prospective operative date of 1 October 2004, thus enabling employers and employees to become aware of the new obligations and entitlements.

[7] Mr Gourlay and Mr Cowie supported the submissions of Mr Fraser.

[8] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[9] The application is granted operative from 1 October 2004.

[10] An order reflecting this decision will follow.
