REASONS FOR DECISION

[1] On 11 August 2004, an application was lodged by the Liquor, Hospitality and Miscellaneous Union, Tasmanian Branch (LHMU), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Licensed Clubs Award.

[2] The application sought to vary Clause 22 - Hours - subclause (c) - Minimum Break between Shifts.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Thursday 9 September 2004 at 9.30 am.

[4] At the hearing Mr P Tullgren appeared for the LHMU and Mr P Mazengarb for the Tasmanian Chamber of Commerce and Industry Limited.

[5] Mr Tullgren and Mr Mazengarb both gave submissions in support of the application, which was by consent.

[6] The award will be varied in the manner sought. The variation is consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[7] The order reflecting this decision, with an operative date of 9 September 2004 is attached.
