REASONS FOR DECISION

(1) On 12 August 2004, an application was lodged by the Transport Workers' Union of Australia (Victorian/Tasmanian Branch), pursuant to s.23 of the Industrial Relations Act 1984, to vary the Transport Workers General Award.

(2) The application sought to insert a new Clause 8(d) - Minimum Wage.

(3) A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 1 October 2004 at 9.30 am.

(4) At the hearing Mr M Cook and Mr I Hall appeared for the Transport Workers' Union of Australia (Victorian/Tasmanian Branch). Mr N Gozzi of the Tasmanian Chamber of Commerce and Industry Limited wrote to the Commission stating that:

"The TCCI would like to formally support the application to vary the Transport Workers General Award...would it be at all possible to avoid the commission hearing and present a document to DP Shelley outlining the consent of the parties concerned?"

(5) Mr Cook gave an oral submission in support of the application.

(6) The award will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

(7) The Order giving effect to this Decision is attached.
