Industrial Agreement - agreement approved - operative 1 January 2004 until 31 December 2006 - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union (AFMEPKIU) and the Minister administering the State Service Act 2000, was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 13 October 2004 at 2.30 pm

[3] The name of the agreement was amended at the hearing to the State Service (AFMEPKIU) Wages Agreement 2004. In the original application it was to be known as the State Service (AFMEPKIU) Wages Agreement No. 2 of 2004. T11678, an applciaiton to register the State Service (AFMEPKIU) Wages Agreement No. 1 of 2004, was withdrawn at the hearing. The agreement is to be operative on and from 1 January 2004 and it is to remain in force until 31 December 2006.

[4] The agreement applies to all employees covered by awards listed in Schedule 1 of the agreement.

[5] An oral submission was presented by Mr T Pearce representing the Minister administering the State Service Act 2000. Ms A Urquhart of the AFMEPKIU sent a letter to the Commission dated 11 October 2004 consenting to the matters "proceeding in our absence."

[6] Having considered the submission, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
