Industrial Agreement - agreement approved - operative 1 July 2003 until 30 June 2005 - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] On 27 August 2004 The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. and TOTE Tasmania Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the TOTE Tasmania Pty Ltd Agreement No. 1 of 2004.

[2] On 31 August 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, to commence on Thursday 9 September 2004 at 10.30am.

[3] The agreement, to be known as the TOTE Tasmania Pty Ltd Agreement No. 1 of 2004, is to be operative on and from 1 July 2003 and it is to remain in force until 30 June 2005.

[4] The agreement applies to all employees covered by awards listed in Schedule 1 of the agreement.

[5] Oral submissions were presented by Mr M Di Pretoro for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. and Craig Coleman of TOTE Tasmania.

[6] Having considered those submissions, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
