Industrial dispute - alleged unfair termination of employment - application dismissed REASONS FOR DECISION [1] This application was lodged by Karen Louise Ritch (the applicant), pursuant to s.29(1A) of the Industrial Relations Act 1984, on 6 September 2004, in respect of an industrial dispute with A & R Northern Cleaners (Tasmania) Pty Ltd (the respondent) re alleged unfair termination of employment. [2] This matter was listed for Hearing (conciliation conference) on 30 September 2004. The conference commenced with preliminary submissions, followed by the parties entering into private discussions in an attempt to settle the dispute. When the conference reconvened, the parties informed the Commission that their negotiations had not settled the dispute. The hearing was adjourned sine die. [3] At the subsequent hearing on 25 and 26 November 2004, Ms D Butler from The Launceston Community Legal Centre Inc. appeared on behalf of the applicant and Mr T Brady from the Tasmanian Chamber of Commerce and Industry, for the respondent. [4] On 25 November 2004 the parties completed their opening submissions and heard evidence from various witnesses. [5] On 26 November 2004, at the commencement of the hearing, Mr Brady presented argument to the Commission seeking dismissal of the application. Ms Butler did not oppose the dismissal. [6] Therefore, pursuant to s.21(2)(c) of the Act, I dismiss the application, and I so Order.
