REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Australian Workers' Union, Tasmania Branch and R.A. & C.P. Storey Pty Ltd, was for the purpose of filing an industrial agreement with the Commission.

[2] On 7 September 2004, the Commission convened a hearing at Supreme Court, Cameron Street, Launceston, Tasmania, before myself, to commence on 8 October 2004 at 10.45 am. However, this was subsequently changed to 30 September 2004 at 1.45 pm.

[3] The agreement, to be known as the R.A. & C.P. Storey Pty Ltd Silviculture and Afforestation Industrial Agreement 2004, is to be operative from 1 September 2004 and it is to remain in force until 31 May 2005.

[4] Mr D Hayes for The Australian Workers' Union, Tasmania Branch and R.A. & C.P. Storey Pty Ltd, presented submissions in support of the consent application.

[5] Having considered the submission of the parties, I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
