INDUSTRIAL AGREEMENT

 REASONS FOR DECISION

 [1] On 13 September 2004, the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch (LHMU) and NGT Tasmania Limited lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The NGT Tasmania (Access & Equity) Casual Employees Industrial Agreement.

[2] When this matter came on for hearing on 21 September 2004, Mr P Tullgren appeared for the LHMU. Mr J Glisson and Mr G Coker-Williams appeared for NGT Tasmania Limited.

[3] Mr Glisson explained that this agreement was designed to facilitate individuals with a range of disabilities, both physical and mental, to be provided with the opportunity to obtain experience back in the workplace.

[4] Mr Glisson said that the Group Training Industry Award was inappropriate and hence the necessity for an agreement designed to provide protection and security for the employees involved.

[5] Mr Tullgren supported the submissions of Mr Glisson.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.55[4] of the Act the agreement is approved operative from 1 March 2004 and shall remain in force for a period of three years.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
