REASONS FOR DECISION

[1] On 13 September 2004, applications were lodged by the Australian Municipal, Administrative, Clerical and Services Union (AMACSU), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Barristers and Solicitors Award, Business Services Award, Clerical and Administrative Employees (Private Sector) Award and the Estate Agents Award.

[2] The applications sought to insert a new `Requirement to work reasonable overtime' clause in accordance with the decisions of the Commission in T10886, T10887, T10927 and T10928 of 2003.

[3] When this matter came on for hearing Mr Ian Paterson appeared for AMACSU and Mr Nick Gozzi appeared for Tasmanian Chamber of Commerce and Industry Limited.

[4] Mr Paterson and Mr Gozzi both gave submissions in support of the applications.

[5] The awards will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The orders reflecting this decision, with an operative date of 28 September 2004, are attached.
