REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Anglicare Tasmania Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 15 September 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Tuesday, 5 October 2004 at 9.30 am.

[3] The agreement, to be known as the Anglicare Tasmania Inc. (Neena/Caylea Support Workers) Industrial Agreement 2004, is to be operative from 5 October 2004 and it is to remain in force for a period of two years.

[4] The agreement applies to employment by the employer of employees covered by the Disability Service Providers Award and are engaged in the MAIB established facilities operated by the employer in the Northern and Southern Region of Tasmania.

[5] Ms S Goldfinch with Mr T Kleyn for the union, and Mr P Mazengarb, from the Tasmanian Chamber of Commerce and Industry Limited, for the employer, presented submissions in support of their consent application.

[6] Having considered the submission of the parties, I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
