HOBART, 12 October 2004

Industrial Agreement - agreement approved - operative 30 August 2004 - to remain in force until 31 May 2005 - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Langford Support Services Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] On 4 October 2004, the Commission convened a hearing at Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania, before myself, to commence on Monday, 11 October 2004 at 10.30 am.

[3] The agreement, to be known as the Langford Support Services Inc. (Temporary Employment Conditions) Industrial Agreement 2004, is to be operative from 30 August 2004 and it is to remain in force until 31 May 2005.

[4] The agreement applies employees covered by the Disability Service Providers Award and are engaged by the employer as "Temporary Employees".

[5] Mr C Stringer for the union the employer, presented submissions in support of the consent application.

[6] Having considered the submission of the parties, I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
