REASONS FOR DECISION

[1] On 22 October 2004, an application was lodged by the Australian Municipal, Administrative, Clerical and Services Union, pursuant to s.23 of the Industrial Relations Act 1984, to vary the Public Vehicles Award.

[2] The application sought to vary Clause 1 - Wage Rates of Part III - Wage Classifications and Related Matters in respect of the Fourth Minimum Rates Adjustment and to insert a new Minimum Wage clause in this Part. It also sought to vary Part V - Hours of Work, Shift Work, Overtime and Related Matters by inserting a new Requirement To Work Reasonable Overtime subclause.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Wednesday 17 November 2004 at 9.30 am. At the hearing Mr I Paterson appeared for the Australian Municipal, Administrative, Clerical and Services Union. Mr N Gozzi appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[4] Both parties gave oral submissions in support of the application. Having considered these submissions, I am satisfied that the application satisfies s.36 of the Act, therefore the award will be varied in the manner sought.

[5] The order reflecting this decision, with an operative date of 17 November 2004, is attached.
