REASONS FOR DECISION

[1] This application was lodged, pursuant to Section 55 of the Industrial Relations Act 1984, by the Shop Distributive and Allied Employees Association, Tasmanian Branch (the union) and Wattyl Australia Pty Ltd (the employer) for the purpose of filing an industrial agreement with the Commission.

[2] Mr J Russell appeared for the union, and the employer forwarded a letter of consent to the agreement.

[3] The agreement, to be known as the SDA/Wattyl Australia Pty. Ltd. Paint Stores Enterprise Agreement 2004, will apply to the employer's operations throughout the State of Tasmania and, specifically, to all employees who occupy classifications contained in Clause 8 of the Wholesale Trades Award and who are members or eligible to be members of the Shop, Distributive and Allied Employees Association, Tasmanian Branch.

[4] Having heard the submissions of the parties in this matter, I am satisfied that the agreement should be approved as it is consistent with the Wage Fixing Principles and does not offend the public interest requirements of the Act.

[5] Pursuant to s.55(4) of the Act, the agreement will be operative from the beginning of the first full pay period commencing on after the 1 July 2004 and remain in force for a period of three years, and I decide accordingly.

[6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
