REASONS FOR DECISION

[1] On 29 October 2004, the Health Services Union of Australia, Tasmania No. 1 Branch and St Lukes Private Hospital Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the St Lukes Private Hospital (Hospital Staff) Enterprise Bargaining Agreement 2004.

[2] When this matter came on for hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart at 11.45am on 16 November 2004, Mr T Kleyn appeared for the union. Mr M Watson, of the Tasmanian Chamber of Commerce and Industry Limited, appeared for the employer.

[3] Mr Watson advised that St Lukes Private Hospital Ltd had been purchased by Calvary Health Care Tasmania in May 2004. The agreement had been negotiated and finalised prior to the purchase date. Calvary Healthcare were fully aware of the agreement at the time of purchase and support the approval of the agreement.

[4] The agreement provides for wage increases of 4% operative from April 2004, January 2005 and January 2006.

[5] Mr Kleyn supported the submissions of Mr Watson.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.55(4) of the Act the agreement is approved operative from the beginning of the first pay period to commence on or after 16 November 2004 and shall remain in force until 31 December 2006.

[8] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
