COMMISSIONER JP McALPINE

HOBART, 29 November 2004

Industrial Agreement - agreement approved - operative from 1 December 2004 - to remain in force until 30 November 2005 - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Health Services Union of Australia, Tasmania No. 1 Branch (the union) and Cosmos Inc. (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] The matter came before the Commission on Monday, 29 November 2004 at 9.45 am.

[3] The agreement, to be operative from 12 December 2004 and known as the Cosmos Inc. (Employee Employment Extra Conditions) Industrial Agreement 2004, is to remain in force until 30 November 2005.

[4] Mr C Stringer, for the union, and Mr A Tubb, for the employer, presented submissions in support of the application.

[6] Having considered the submissions of the parties, I am satisfied the agreement should be approved as it is consistent with s.36 of the Industrial Relations Act 1984, and I decide accordingly.

[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
