REASONS FOR DECISION

[1] On 26 November 2004, the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) and Calvary Health Care Tasmania lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Calvary Health Care Tasmania (Hospital Staff) Enterprise Bargaining Agreement 2004.

[2] When this matter came on for hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 30 November 2004, Ms S Goldfinch appeared for the HSUA. Mr M Watson, of the Tasmanian Chamber of Commerce and Industry Limited, appeared for Calvary Health Care Tasmania.

[3] Mr Watson explained that this agreement had been negotiated through a workplace committee and had been endorsed by 92% of affected employees in a subsequent secret ballot.

[4] The agreement provides for a 12% salary increase spread over three annual adjustments.

[5] Other matters affected by the agreement include:

  • Redundancy provisions
  • Salary packaging
  • Paid maternity leave
  • Sick and carer's leave
  • Overpayments
  • Public holidays and purchased annual leave
  • Daylight saving
  • Remote call allowance
  • Hours of work for health professionals

[6] Ms Goldfinch supported the submissions of Mr Watson.

[7] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[8] Pursuant to s.55(4) of the Act, the agreement is approved operative from the beginning of the first pay period to commence on or after 30 November 2004 and shall remain in force until 30 June 2007.

[9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
