Industrial agreement - agreement approved - operative 20 December 2004 - to remain in force for a period of three years - forwarded to Registrar for registration REASONS FOR DECISION [1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Liquor, Hospitality and Miscellaneous Union - Tasmanian Branch (the union) and the Phoenix Children's Services Inc. (the employer), for the filing of an industrial agreement. [2] The matter came before the Commission at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, Tasmania on Monday, 20 December 2004 at 10.00 am. [3] The agreement, to be operative on and from 20 December 2004, and known as the Phoenix Children Services (Full Time Employees Hours of Work) Industrial Agreement 2004, is to remain in force for a period of three years. [4] Mr P Tullgren for and on behalf of the Union and Ms C Lang for and on behalf of the employer, presented submissions in support of the application. [5] Having considered the submissions of the parties, I am satisfied the agreement should be approved as there was no evidence to suggest the agreement was inconsistent with s.36 of the Act, and I decide accordingly. [6] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
