REASONS FOR DECISION

[1] On 3 December 2004, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch and Noble Concrete and Excavations Pty Ltd lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the CFMEU - Noble Concrete and Excavations Pty Ltd Enterprise Agreement 2004-2007.

[2] When this matter came on for hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 15 December 2004, Mr B White appeared for the CFMEU. Mr M Southwell appeared for Noble Concrete and Excavations Pty Ltd .

[3] Mr White explained that the agreement provided for regular wage adjustments during the life of the agreement, an additional incentive based on volume of concrete pumped, redundancy provisions and a dispute settling procedure.

[4] Mr Southwell consented to the agreement.

[5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] Pursuant to s.55[4] of the Act, the agreement is approved operative from 29 November 2004 and shall remain in force until 1 November 2007.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
