REASONS FOR DECISION

[1] On 3 December 2004, the Construction, Forestry, Mining and Energy Union, Tasmanian Branch and R J Balmforth lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the CFMEU and R J Balmforth Enterprise Agreement 2004-2007.

[2] When this matter came on for hearing at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on 15 December 2004, Mr B White appeared for the CFMEU and we received a letter from Mr R J Balmforth authorising the CFMEU to represent him.

[3] Mr White explained that this agreement provided for regular wage adjustments during the life of the agreement, an enterprise allowance, enhanced fares and travel allowance, redundancy provisions and dispute settling procedure.

[4] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[5] Pursuant to s.55[4] of the Act, the agreement is approved operative from 30 November 2004 and shall remain in force until 1 November 2007.

[6] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
