REASONS FOR DECISION

[1] On 6 December 2004, an application was lodged by The Community and Public Sector Union (State Public Services Federation Tasmania) Inc., pursuant to s.23 of the Industrial Relations Act 1984, to vary the General Conditions of Employment Award and the Community and Health Services (Public Sector) Award.

[2] The application sought to vary vehicular expense related allowances.

[3] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Monday 20 December 2004 at 10.30 am.

[4] At the hearing Mr M Johnston appeared for the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. Mr P Baker appeared on behalf of the Minister administering the State Service Act 2000. Mr P Aiken appeared for the Health Services Union of Australia, Tasmania No. 1 Branch. All of the above gave verbal submissions in support of the application.

[5] The award will be varied in the manner sought. The variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[6] The Orders giving effect to this Decision are attached.
