COMMISSIONER T J ABEY

HOBART, 21 January 2005

Industrial agreement - application approved - operative date 14 January 2005 - 3 years

REASONS FOR DECISION

[1] On 7 January 2005, The Australian Workers' Union, Tasmania Branch (AWU), the Construction, Forestry, Mining and Energy Union, Tasmanian Branch (CFMEU) and SADB Directional Drilling lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Tas-Vic Interconnector Consortium Basslink Project Tasmania SADB Directional Drilling Agreement 2003-2006.

[2] When this matter came on for hearing on 14 January 2005, Mr R Flanagan appeared for the AWU and Mr W White appeared for the CFMEU. By facsimile dated 13 January 2005, SADB Directional Drilling authorised Mr Flanagan to also appear on their behalf.

[3] Mr Flanagan explained that this agreement was similar to a number of others applicable to this project and registered with the Commission.

[4] The agreement would apply to employees engaged on directional drilling and associated earthworks.

[5] Mr White supported the submissions of Mr Flanagan.

[6] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[7] Pursuant to s.55(4) of the Act, the agreement is approved operative from 14 January 2005 and shall remain in force for a period of three years.
