REASONS FOR DECISION
[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (the union) and the Minister administering the State Service Act 2000 (the employer), was for the purpose of filing an industrial agreement with the Commission.
[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 4 February 2005 at 9.30 am.
[3] The agreement, to be known as the Port Arthur Historic Site Industrial Agreement 2004, is to be operative on and from 4 February 2005 and it is to remain in force until 31 December 2006.
[4] The agreement applies to all employees covered by the Port Arthur Authority Award.
[5] Oral submissions were presented by Mr M Di Pretoro of the Community and Public Sector Union (State Public Services Federation Tasmania) Inc. and Mr P Baker for the Minister administering the State Service Act 2000. At the hearing Clause 1 - Period of Operation, Clause 3 - Multi-Skilled Labourer and Clause 6 - Bereavement Leave were amended.
[6] Having considered those submissions, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement.
[7] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
