THE DEPARTMENT OF JUSTICE (COMMUNITY CORRECTIONS SERVICE - PROFESSIONAL EMPLOYEES) AGREEMENT 2004

REASONS FOR DECISION

[1] On 11 January 2005, the Minister Administering the State Service Act 2000 (the Minister), The Community and Public Sector Union (State Public Services Federation Tasmania) Inc. (CPSU) and the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA) lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, The Department of Justice (Community Corrections Service - Professional Employees) Agreement 2004.

[2] When this matter came on for hearing on 21 January 2005, Mr J Evans appeared for the Minister with Mr N McCulloch for the Community Corrections Service, Mr T Lynch, for the CPSU and Mr T Kleyn for the HSUA.

[3] Mr Evans explained that the agreement was made in respect of those current employees of the Community Corrections Service of the Department of Justice who, at the 7 March 1996, did not possess appropriate qualifications, which enabled their translation from the Welfare Workers Award to the Professional Employees Award (Level 1) from that date.

[4] Mr McCulloch, Mr Lynch and Mr Kleyn all supported the submissions of Mr Evans.

[5] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] Pursuant to s.55(4) of the Act, the agreement is approved operative on and from 22 November 2004 and shall remain in force until 30 April 2006.

[7] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
