REASONS FOR DECISION

[1] On 24 January 2005, an application was lodged by the Health Services Union of Australia, Tasmania No. 1 Branch (HSUA), pursuant to Section 23 of the Industrial Relations Act 1984, to vary the Nursing Homes Award.

[2] When this matter came on for hearing on 17 February 2005, Mr T Kleyn appeared for the HSUA. Mr M Watson appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[3] Mr Kleyn explained that meal allowances had not been adjusted since 1992. This application reflected movement in the CPI ABS Catalogue 601, "Meals and Takeaway Food," being an adjustment of 42.14%.

[4] Mr Watson signified consent to the application.

[5] I am satisfied that the application is consistent with both the Wage Fixing Principles and the public interest requirements of the Act.

[6] The application is granted operative from the beginning of the first pay period to commence on or after 17 February 2005.

[7] The Order reflecting this decision is attached.
