Industrial Agreement - agreement approved - operative 17 February 2005 until 15 November 2007 - forwarded to the Registrar for registration

REASONS FOR DECISION

[1] This application, lodged pursuant to s.55 of the Industrial Relations Act 1984 by the Construction, Forestry, Mining and Energy Union - Tasmanian Branch (the union) and Height Safety Management (the employer), was for the purpose of filing an industrial agreement with the Commission.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart, before myself, on Thursday 17 February 2005 at 10.30 am.

[3] The agreement, to be known as the CFMEU & Height Safety Management Enterprise Agreement 2004-2007, is to be operative on and from 17 February 2005 and it is to remain in force until 15 November 2007.

[4] The agreement applies to all direct employees of Height Safety Management in Tasmania engaged on civil and building construction sites.

[5] Oral submissions were presented by Mr M Huxley of the Construction, Forestry, Mining and Energy Union - Tasmanian Branch. Mr R Sheedy, the Managing Director of Height Safety Management sent correspondence to the Commission advising that "I hereby authorise the Construction, Forestry, Mining and Energy Union to represent me at the above hearing."

[6] At the hearing, I amended Clause 6 - Rates of Pay and Allowances and Clause 20 - Allowances - Meal Fares and Travel Pattern Allowances of the agreement.

[7] Having considered the submissions, I am satisfied the agreement does not offend s.36 of the Act or the Wage Fixing Principles and I approve the agreement as amended.

[8] The file will now be referred to the Registrar in accordance with the requirements of s.56(1) of the Act.
