REASONS FOR DECISION

[1] This is an application pursuant to s.23 of the Industrial Relations Act 1984, made by the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union and lodged on 1 February 2005.

[2] Mr G Duffield with Mr T Morley for the printing Authority of Tasmania, Mr D Hanish for the Automotive, Food, Metals, Engineering, Printing & Kindred Industries Union and Mr R Miller for The Community and Public Sector Union (State Public Services Federation Tasmania) Inc, presented submissions in support of their consent application.

[3] The application sought to vary the Printing Authority of Tasmania Award as detailed in the draft Order1 provided by the parties, in the following manner:

Clause 7 Definitions - deleted and replaced by new Clause 7. Most definitions moved from Clause 7 - Definitions - to other relevant clauses

Clause 9 Consultation and Communication Framework - deleted and replaced by new Clause 10

6.

Clause 13 Higher Duties Allowance - deleted and replaced by new Clause 15

7.

Clause 14 More responsible Duties - deleted

8.

Clause 16 Salary Sacrifice - New clause inserted

9.

Clause 17 Flexible Working House - deleted and replaced by new Clause 17

10.

Clause 18 Posting of Work Hours - deleted

11.

Clause 20 Overtime - sub-clause (a) deleted and replaced by new sub-clause (a)

12.

Clause 21 Shift Work - deleted and replaced by new Clause 20

13.

Clause 22 Contract of Employment - deleted and replaced by new Clause 21. Loading for casuals increased from 20% to 25%.

Clause 23 Termination of Employment - deleted and replaced by new Clause 22

15.

Clause 25 Redundancy Payments - deleted and replaced by new Clause 24

16.

Clause 27 Competency Based Career Structure - deleted

17.

Clause 28 Annual Leave - deleted and replaced by new Clause 26

18.

Clause 29 Annual Leave Loading - deleted

19.

Clause 33 Special Leave - deleted and replaced by new Clause 30

20.

Clause 34 Sick leave - deleted and replaced by new Clause 31

21.

Clause 37 Leave Without Pay - deleted and replaced by new Clause 34

22.

Clause 37 Union Training - new clause

23.

Clause 39 Public Holiday - deleted and replaced by new Clause 36 - Statutory Holidays

24.

  "Partner" added to definitions where necessary

25.

  Consequential re-numbering and changes

[4] Having heard the submissions from the parties, I am satisfied that the award should be varied in the manner set out in the draft order. In approving the application, I am satisfied it is consistent with both the Wage Fixing Principles and the public interest test required pursuant to s.36 of the Act.

[5] The application is granted and the Order giving effect to this decision is attached, operative on and from 23 February 2005.
