Industrial agreement - application approved - operative date 2 May 2005 - 1 July 2007 - forwarded to Registrar for registration REASONS FOR DECISION [1] On 11 April 2005, the Health Services Union of Australia, Tasmania No. 1 Branch and Regional Imaging Pty Ltd trading as Regional Imaging Tasmania lodged with the Registrar, pursuant to Section 55(2) of the Industrial Relations Act 1984, the Regional Imaging Pty Ltd trading as Regional Imaging Professional Staff Enterprise Agreement 2004. [2] When this matter came on for hearing on 2 May 2005, Mr T Kleyn appeared for the HSUA. Mr T McCarthy and Mrs B Nicholson appeared for Regional Imaging. [3] Mr McCarthy explained that this agreement resulted from extensive negotiations involving a genuine bargaining process. Employees had elected their own representatives who worked closely with union officials to bring the agreement to fruition. [4] The final agreement had been overwhelmingly endorsed by employees. [5] The agreement had been substantially re-formatted so that like matters were grouped together. The agreement also contained a totally new classification structure. [6] Mr Kleyn adopted the submissions of Mr McCarthy. [7] I am satisfied that the agreement is consistent with both the Wage Fixing Principles and the public interest requirements of the Act. [8] Pursuant to s. 55 of the Act, the agreement is approved operative from 2 May 2005 and shall remain in force until 1 July 2007. [9] The file will now be referred to the Registrar for registration in accordance with the requirements of Section 56(1) of the Act.
