REASONS FOR DECISION

[1] On 11 May 2005 The Australian Workers' Union, Tasmania Branch applied for a hearing pursuant to section 23 of the Industrial Relations Act 1984 to vary the Horticulturists Award. The application sought to vary the Hours of Work clause to provide for a 38 hour week.

[2] A hearing commenced at the Commonwealth Law Courts, 39-41 Davey Street, Hobart on Friday 29 July 2005 at 9.30 am.

[3] At the hearing Mr R Flanagan appeared for The Australian Workers' Union, Tasmania Branch. Mr M Watson appeared for the Tasmanian Chamber of Commerce and Industry Limited.

[4] Both parties gave oral submissions in support of the application. Having considered these submissions, I am satisfied that the variations are consistent with the Wage Fixing Principles and the public interest requirements of the Act.

[5] The order reflecting this decision, with an operative date of the first full pay period on or after 29 July 2005, is attached.
